Although the goal in every case is to negotiate a fair and reasonable agreement without litigation, this is not always possible. In either event, litigation or settlement, the goal is to get the best result for the Client.

BANKRUPTCY

Chapter 7 is designed for debtors who can not pay their debts. In a Chapter 7 Bankruptcy the debtor is discharged of all their debts. However, some debts are not discharged under the law even though they were listed in your Chapter 7 Bankruptcy Petition. For example, debts for student loans, taxes, alimony, support payments, criminal restitution, etc... are not dischargeable. Under certain circumstances a debtor may exempt his property and be able to keep certain property, i.e. car, house, etc...

Chapter 13 is designed for debtors who have regular incomes but who are temporarily unable to pay their debts but would like to pay them in installments over a period of time. Essentially, the debtor presents a plan to the Bankruptcy Court of repayment of either all or a percentage of your debts over a certain number of years.
